According to this Forum it seems to be German law, how to deal with a situation like this. But you HAVE to grant an additional grace period of at least two weeks, once you are 6 weeks over the non-binding delivery date. Only after that additional time passes you can cancel.
Note: I am Swiss, so I don't know the exact specifics.
